Terms of sale and use

These terms govern your purchase and use of the Retirement Preflight application, supplied by Preflight Retirement LLC (“we”, “us”). By installing or using the software you agree to them.

1. Not financial advice

2. Scope — United States only

The software models United States tax law and United States retirement and health programs: federal income tax, the tax rules of the 50 states and the District of Columbia, Social Security, Medicare and its IRMAA surcharges, Affordable Care Act premium credits, and required minimum distributions.

It does not model the tax, pension, social-insurance or healthcare system of any other country, and it has no non-US mode. The software is not intended to be sold or used outside the United States, and its output is meaningful only for a household filing United States taxes. If you are taxed outside the United States, this software is not fit for your purpose, and we say so here rather than let you discover it after buying. Our refund policy applies if you bought it on that misunderstanding.

3. License

We grant you a personal, non-exclusive, non-transferable license to install and use the software for your own household planning, or for your internal business use if you bought it as an organization.

You may not:

• redistribute, resell, sublicense or publish the software or a license key;
• reverse-engineer, decompile or disassemble it, except where law expressly permits;
• circumvent, disable or attempt to defeat the licensing mechanism;
• remove or obscure any proprietary notice.

The Core license is a one-time purchase and does not expire. Tax-data packs are separate one-time purchases and are not included with a Core license. We retain all rights not expressly granted.

4. Purchases

Purchases are processed by Lemon Squeezy, which acts as merchant of record and is therefore the seller of record for your transaction. Their terms additionally apply to the payment itself, and they are responsible for collecting and remitting any applicable sales tax or VAT.

Prices are shown at checkout and may change; the price you were shown when you bought is the price that governs your purchase.

6. Updates and availability

We may release updates that change, add or remove functionality. We aim to keep the software working and useful, but we do not promise any particular update, feature, or period of continued availability.

Published tax law ships inside the program rather than inside your saved plans. A consequence you should expect: updating the software can change the numbers an existing plan produces, because the plan is recomputed against the law the new version carries. The law year in use is shown in the application.

7. No warranty

The software is provided “as is” and without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

We do not warrant that the software is free of errors, that its tax modeling is complete or correct for your circumstances, or that its output is suitable for any decision you may take. Tax law is intricate, varies by jurisdiction, changes over time, and is modeled here in a necessarily simplified form.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost savings, lost data, or any financial loss arising from decisions made in reliance on the software.

Our total aggregate liability arising out of or relating to the software or these terms will not exceed the amount you actually paid us for it in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations, so parts of the two paragraphs above may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.

9. Termination

This license ends if you materially breach these terms. On termination you must stop using the software and remove it. Your plan files are yours and remain on your own disk regardless.

10. Talk to us first

Before either of us starts a legal proceeding, we ask for thirty days to sort it out by email. Send a short written notice to support@preflightretirement.com describing the problem and what you would like us to do about it; we will send you the equivalent notice if the complaint is ours. Most disputes over a one-time software purchase are a bug, a billing mix-up or a misunderstanding, and all three are resolved faster and more cheaply by email than by filing.

Completing this step is a condition of bringing a claim. It does not extend or shorten any limitation period that applies to that claim, and it does not prevent either party from seeking urgent injunctive relief in the meantime.

11. Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Subject to Section 10 above, the state and federal courts located in Clark County, Nevada will have exclusive jurisdiction over any dispute arising out of or relating to these terms or the software, and both parties consent to that jurisdiction and venue — except that either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes to these terms

We may revise these terms; the current version is always posted here with its date. Changes are not retroactive and do not alter the terms that applied to a purchase already made.
